The agreement between us, in plain terms.
The terms that govern your use of bequest.love: what we provide, what the solicitors provide, what you agree to, and where each responsibility sits. Written to be read, not skimmed.
Please read these Terms of Service carefully before using bequest.love. By creating an account or using any Bequest product or service, you agree to be bound by these Terms. If you do not agree, please do not use our platform.
About our products
Two categories of product, with two very different relationships behind them.
Bequest offers two categories of product through the Platform.
Legal documents
Wills, Enduring Powers of Attorney (EPOA), and Advance Medical Directives (AMD). When you purchase a legal document through Bequest, the legal review, witnessing, and execution of your document are provided by Patricia Ho and Associates, an independent Hong Kong solicitors’ firm, as an integrated part of the product. You cannot purchase a Bequest legal document without engaging Patricia Ho and Associates as your solicitors for that document. Your relationship with Bequest is governed by these Terms. Your relationship with Patricia Ho and Associates is governed by a separate engagement letter provided by the firm.
Non-legal products
Final Wishes, and any future non-legal tools. These products are provided by Bequest alone. No solicitor is involved. A single contract, a single payment, and these Terms govern the entire relationship.
Definitions
In these Terms, the following words have the following meanings.
Acceptance of terms
By accessing or using the Platform, you confirm a few things about yourself.
By accessing or using the Platform, you confirm that:
- you are at least 18 years of age;
- you have the legal capacity to enter into a binding agreement;
- you are using the Platform for your own personal life planning purposes and not on behalf of any other person, unless otherwise expressly agreed with Bequest in writing; and
- you have read, understood, and agree to be bound by this Agreement.
If you are accessing the Platform on behalf of an organisation or as a licensed professional, additional terms may apply. Please contact us at hello@bequest.love.
If Bequest discovers that a person under the age of 18 has created an account by misrepresenting their age, Bequest reserves the right to immediately suspend or terminate that account and delete the associated data. Any Document Outputs generated by a minor using the Platform are generated without Bequest’s knowledge or consent and Bequest accepts no responsibility for them.
Nature of the service
Bequest is a life planning platform. It is not a law firm.
Bequest is a life planning platform. We provide technology that guides you through the process of creating estate planning documents using solicitor-reviewed templates designed for use in Hong Kong.
Legal Document Services (Wills, EPOA, AMD)
The legal review, witnessing, and execution of your document are provided by Patricia Ho and Associates as an integrated, non-optional part of the product. When you purchase a Bequest legal document, you engage both Bequest (for the platform) and Patricia Ho and Associates (for the legal services). The solicitor is not an add-on you opt into. It is part of what a Bequest will, EPOA, or AMD is.
Non-Legal Products (Final Wishes)
The product is produced and delivered by Bequest alone. No solicitor is involved.
Our Services are designed for individuals with straightforward life planning needs. If your circumstances are complex, involve business interests, disputed family arrangements, offshore assets, or any other matter that may require professional legal guidance, we recommend you seek independent legal advice.
References on the Platform to solicitor-reviewed templates indicate that the template structures have been reviewed by a qualified legal practitioner. This does not mean that any specific Document Output has been reviewed by a solicitor or that it is appropriate for your individual circumstances.
Account registration
One account per person, kept accurate and kept secure.
To access the Services, you must create an account. You agree to:
- provide accurate, current, and complete information when registering;
- keep your account information up to date;
- maintain the confidentiality of your password and account credentials; and
- notify us immediately at hello@bequest.love if you believe your account has been accessed without authorisation.
You are responsible for all activity that occurs under your account. Bequest is not liable for any loss or damage arising from your failure to maintain the security of your account credentials.
You may only hold one account. Bequest reserves the right to suspend or terminate duplicate accounts.
Products and services
The features, inclusions, and pricing for each product are set out on the Platform and may be updated from time to time.
A. Legal Document Services
Each Legal Document Service includes document preparation through the Platform and integrated legal review, witnessing, and execution by Patricia Ho and Associates.
B. Non-Legal Products
Bequest reserves the right to modify, suspend, or discontinue any product or feature at any time with reasonable notice.
Payment and refunds
All products are one-time purchases. There are no subscriptions and no auto-renewal.
A. General
Access to certain Services requires payment. Pricing is set out on the Platform and may be updated from time to time. All products are one-time purchases: there are no recurring subscriptions or auto-renewal charges.
- Payments are processed by Stripe, Inc. By making a purchase, you agree to Stripe’s terms of service. Bequest does not store your card or payment details.
- All fees are stated in Hong Kong Dollars and are inclusive of any applicable taxes unless otherwise stated.
- If a payment fails, Bequest may suspend your access to paid features until payment is received.
B. Legal Document Services: additional terms
For Legal Document Services, you make two separate payments at checkout: a platform fee to Bequest and a legal fee to Patricia Ho and Associates. Both fees are displayed before you confirm payment.
Payment of the legal fee does not by itself create a solicitor-client relationship with Patricia Ho and Associates. Before PHA can act for you, PHA must complete its standard client onboarding process, including a conflict-of-interest check and customer due diligence. You will receive a separate engagement letter from PHA confirming the terms of the solicitor-client relationship.
If PHA is unable to act for you, for example because a conflict of interest is identified or customer due diligence cannot be completed, PHA will notify you. In that case:
- the legal fee paid to PHA will be refunded to you in full;
- the platform fee paid to Bequest will not be refunded, as the platform service (document preparation) has been provided; and
- you will not receive solicitor review or witnessing of your document through Bequest, and you will need to arrange your own legal review if you wish to proceed with the document.
For the avoidance of doubt, the “no refunds” general position in Section 06(C) below is subject to this express carve-out for legal fees where PHA cannot act.
C. Refunds: Non-Legal Products
For Non-Legal Products, Bequest does not offer refunds except where required by applicable law. Final Wishes is a digital product delivered immediately upon completion, and the nature of the product means it cannot be returned.
Document Output disclaimer
Document Outputs are built from the information you provide. We do not verify it for you.
The Document Outputs generated by the Platform are produced on the basis of the information you provide. Bequest does not independently verify the accuracy or completeness of the information you enter. You are solely responsible for ensuring that the information you provide is accurate, complete, and up to date.
For Legal Document Services, your Document Output will be reviewed by a solicitor at Patricia Ho and Associates as part of the integrated legal service, after the document has been generated by the Platform. The legal review by PHA is separate from the document generation by Bequest.
Certain documents generated through the Platform, including wills and Enduring Powers of Attorney, require proper execution (signing, witnessing, and in some cases other formalities) to take legal effect. Patricia Ho and Associates will guide you through the execution requirements for Legal Document Services. For Non-Legal Products, execution requirements do not apply.
Legal services: Patricia Ho and Associates
How the solicitor relationship works when you buy a legal document.
A. Legal Document Services
When you purchase a Legal Document Service (Will, EPOA, or AMD), the legal review, witnessing, and execution of your document are provided by Patricia Ho and Associates as an integrated part of the product. This section describes how that relationship works.
B. Non-Legal Products
For Non-Legal Products such as Final Wishes, no solicitor is involved. The product is produced and delivered by Bequest alone. No legal services are provided, and no solicitor-client relationship is created.
Acceptable use
Use the Platform lawfully, and only for your own genuine life planning.
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:
- use the Platform to create documents on behalf of another person without their knowledge and consent;
- provide false, misleading, or fraudulent information in connection with any Document Output;
- attempt to gain unauthorised access to any part of the Platform, another user’s account, or any Bequest system;
- use automated tools, bots, or scrapers to access or extract content from the Platform;
- use the Platform for any commercial purpose other than as expressly permitted by Bequest in writing;
- interfere with or disrupt the Platform or any servers or networks connected to it; or
- use the Platform in any way that violates applicable law, including the laws of Hong Kong.
Bequest reserves the right to suspend or terminate your account if it reasonably believes you have breached any of the above.
Intellectual property
We own the platform. You own the personal content of your documents.
All intellectual property rights in the Platform, its software, technology, user interface, and underlying systems vest in Bequest or its licensors. Nothing in these Terms transfers any intellectual property rights in those assets to you.
You own the personal content of any Document Output generated on the basis of information you provide, that is, the specific instructions, choices, and personal details reflected in your document. Bequest owns the platform technology used to generate Document Outputs.
For Legal Document Services, the legal documents are produced under the professional responsibility of Patricia Ho and Associates. Bequest does not claim ownership of the legal precedents or templates used by PHA in the provision of legal services.
Subject to your compliance with these Terms and payment of applicable fees, Bequest grants you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for your personal life planning purposes.
You must not copy, reproduce, distribute, reverse-engineer, or create derivative works from any part of the Platform or its content without Bequest’s prior written consent.
You retain ownership of any personal information you provide to the Platform. By submitting information through the Platform, you grant Bequest a limited licence to use that information solely to the extent necessary to provide the Services.
If you submit feedback, suggestions, or ideas about the Platform or Services to Bequest, you assign to Bequest all intellectual property rights in that feedback. Bequest may use such feedback freely without any obligation of confidentiality, attribution, or compensation to you.
Disclaimers and limitation of liability
The Platform is provided on an “as is” and “as available” basis.
The Platform and Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Bequest disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Bequest does not warrant that:
- the Platform will be available at all times or free from errors, interruptions, or security vulnerabilities;
- any Document Output will be suitable for your circumstances, legally effective, or free from defect; or
- any information provided on the Platform is accurate, complete, or current.
To the fullest extent permitted by applicable law, Bequest’s total liability to you in connection with these Terms, the Platform, or any Services shall not exceed the total fees paid by you to Bequest in the twelve months preceding the event giving rise to the claim, subject to a minimum of HKD 5,500.
Bequest shall not be liable for any indirect, consequential, special, incidental, or punitive losses or damages of any kind, including loss of data, loss of profit, or loss of opportunity, whether arising in contract, tort, or otherwise, even if Bequest has been advised of the possibility of such losses.
Third-party services
The Platform integrates with services governed by their own terms.
The Platform integrates with certain third-party services. These are governed by their own terms and privacy policies. Bequest is not responsible for the content, practices, or conduct of any third party.
Your use of any third-party service accessed through the Platform is at your own risk.
Suspension and termination
You can close your account at any time. So can we, in limited circumstances.
You may close your account at any time by contacting hello@bequest.love.
Bequest may suspend or terminate your account at any time with or without notice if it reasonably determines that:
- you have breached any provision of these Terms;
- your use of the Platform poses a security or legal risk; or
- Bequest is required to do so by law or regulatory order.
Upon termination, your right to access the Platform will cease. Bequest will retain your data in accordance with the Privacy Notice and applicable law.
For the avoidance of doubt, termination does not retroactively invalidate any Document Outputs completed before termination.
Changes to these Terms
We will give you at least 14 days’ notice of any material change.
Bequest may update these Terms from time to time. Where changes are material, we will notify you by email or through a notice on the Platform at least 14 days before the changes take effect.
Your continued use of the Platform after the effective date of any updated Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Platform and may close your account.
Governing law and disputes
Hong Kong law governs these Terms. This section covers disputes with Bequest only.
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Hong Kong.
In the event of any dispute, both parties agree to first attempt to resolve the dispute through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, either party may refer the matter to the courts of Hong Kong, which shall have exclusive jurisdiction.
For Legal Document Services: any complaint or dispute relating to the legal quality of your document, the legal advice provided, or the conduct of Patricia Ho and Associates should be directed to PHA under the complaints procedure set out in PHA’s engagement letter. PHA’s professional obligations, including its complaints handling and professional indemnity, are governed by the Law Society of Hong Kong and the applicable regulatory framework for Hong Kong solicitors. Disputes between you and PHA are governed by the terms of PHA’s engagement letter, not by this Section 15.
For the avoidance of doubt, this Section 15 governs disputes between you and Bequest only. Disputes between you and Patricia Ho and Associates are governed by the dispute resolution provisions in PHA’s engagement letter.
Force majeure
Some failures are beyond anyone’s reasonable control.
Bequest shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond Bequest’s reasonable control, including but not limited to acts of God, natural disasters, pandemic, government action, regulatory change, failure of third-party infrastructure or telecommunications networks, or cyberattack.
Where a force majeure event continues for more than 30 days, either party may terminate the affected Services on written notice without liability, and Bequest will provide a pro-rata refund of any prepaid fees for the affected period.
General
