Sign with your doctor

You arrange your own registered medical practitioner. The doctor confirms your mental capacity and, if verified, signs as the first witness.

Bring the signed document back to the firm. Your appointed attorneys must also attend and sign. The firm then finalises the execution and gives you the original to keep. Your EPOA is now in place.

You choose when it takes effect

Your EPOA can be effective immediately on signing, from a fixed date, or only when you lose mental capacity. Most people choose the incapacity trigger. Your attorney only steps in when it becomes necessary, and not before. You stay in control for as long as you are able.

Registration, if the time comes

Your EPOA is registered with the High Court only if you start to lose mental capacity. At that point your attorney applies for registration, and cannot act for you until it is done. The court charges a fee for the application.

Who needs an EPOA

It's not just for old age.

A stroke. A car accident. A sudden diagnosis. If you cannot speak for yourself, your bank account freezes, your medical bills and mortgage go unpaid, your financial affairs unravel. Mental incapacity can happen to anyone at any age. Without an EPOA, your family may need to apply to the High Court to manage your affairs. That takes months, and costs significantly more. An EPOA costs HKD 9,000 and one appointment. It's one of the most practical things you can do for the people who depend on you.

Questions people ask.

No. A Will takes effect when you die. An EPOA operates while you are alive. They serve different purposes. Many people have both.
Someone you trust absolutely. Usually a spouse, an adult child, or a close relative. They will have access to your bank accounts, property, and investments. You can appoint more than one person and specify whether they act together or independently.
No. An EPOA covers property and financial affairs only. For health and medical decisions you need an Advance Medical Directive (AMD), which is a separate document made under different rules.
Your EPOA can be revoked while you have capacity. You can also make a new one. As long as you are mentally capable, you remain in control.
