Enduring Power of Attorney

A stroke. A car accident. A sudden diagnosis. If you cannot speak for yourself, your bank account freezes, your medical bill and mortgage goes unpaid, your financial affairs unravel. An EPOA names the person who steps in, on your terms.

What's included

What you get.

Your EPOA, in the prescribed form

The wizard asks what matters and builds your EPOA in the form required by law. Appoint one attorney or more. Set the scope. Add conditions if you want. You review everything before it is final.

Reviewed and finalised by Patricia Ho and Associates

A solicitor reviews your EPOA for completeness and legal compliance before you take it to your doctor. After your doctor signs, Patricia Ho and Associates finalises the document and submits it to the High Court.

You choose when it takes effect

Your EPOA can be effective immediately on signing, from a fixed date, or only when you lose mental capacity. Most people choose the incapacity trigger. Your attorney only steps in when it becomes necessary, and not before. You stay in control for as long as you are able.

Registration handled for you

Registration with the High Court is required once you are losing mental capacity. Patricia Ho and Associates handles the filing, and the registration fee is included in your price. You do not need to worry about it.

How it works

From form to registered EPOA, in five steps.

1

Answer a few questions

The wizard asks who you want to appoint, what powers they should have, and any limits you want to set. Plain English. No legal knowledge required. Takes about 15 minutes.

2

Book your appointment and pay

Choose your signing appointment. Complete your payment of HKD 9,000. Discounts available when bundled with an AMD or Will. Doctor's witnessing fee paid separately, arranged directly with your doctor.

3

Patricia Ho and Associates reviews

A solicitor reviews your EPOA for completeness and compliance under Cap. 501. This happens before you take the form to your doctor.

4

Sign with your doctor

You arrange your own registered medical practitioner. The doctor confirms your mental capacity and, if verified, signs as the first witness.

5

Patricia Ho and Associates finalises and submits

Bring the signed document back to Patricia Ho and Associates. Your appointed attorneys must also attend and sign. The firm then finalise the execution and register your EPOA with the High Court. Done.

Who needs an EPOA

It is not just for old age.

An accident. An illness. A sudden diagnosis. Mental incapacity can happen to anyone at any age. Without an EPOA, your family may need to apply to the High Court to manage your affairs, a process that takes months and costs significantly more. An EPOA costs HKD 9,000 and one appointment. It is one of the most practical things you can do for the people who depend on you.

Without an EPOA

No one can touch your bank accounts or property without a court order. Your family must apply to the High Court to be appointed, a process that takes months and costs significantly more, while the bills keep coming.

With an EPOA

The person you chose can step in without delay. No court application, no months of waiting, and no fight for access. Your affairs are handled by someone you trust, exactly as you set out.

Registered with the High Court. An EPOA is prepared under the Enduring Powers of Attorney Ordinance (Cap. 501). Patricia Ho and Associates handles registration with the High Court.

Common questions

Questions people ask.

No. A Will takes effect when you die. An EPOA operates while you are alive. They serve different purposes. Many people have both.
Someone you trust absolutely. Usually a spouse, an adult child, or a close relative. They will have access to your bank accounts, property, and investments. You can appoint more than one person and specify whether they act together or independently.
No. An EPOA covers property and financial affairs only. For health and medical decisions, you need an Advance Medical Directive (AMD). Bequest offers both. See the AMD
Your EPOA can be revoked while you have capacity. You can also make a new one. As long as you are mentally capable, you remain in control.
You choose. Your EPOA can take effect immediately on signing, from a fixed date you specify, or only when you lose mental capacity. Most people choose the incapacity trigger. It is insurance, not surrender.

It is easier to set one up now than to go to court later.

One form. One solicitor. HKD 9,000. Your family will not have to fight for access to your own bank account.
